A worker, while at work, shall:
- Take every reasonable precaution to protect the workers' own occupational health and safety and that of other persons at or near the workplace;
- Cooperate with the employer and with the other workers to protect the worker’s own occupational health and safety and that of other persons at or near the workplace;
- Wear or use such individual protective equipment as is required by the Occupational Health and Safety Act and the regulations;
- Consult and cooperate with the occupational health and safety committee or representative, if any:
- Cooperate with any person performing a duty or exercising a power conferred by the Occupational Health and Safety Act or the regulations; and
- Comply with this Act and the regulations.
Where a worker believes that any condition, device, equipment, machine, material or item or any aspect of the workplace is or may be dangerous to the workers’ health or safety or that of any other person at the workplace, the worker:
- Shall immediately report it to the supervisor;
- Shall, where the matter is not remedied to the worker’s satisfaction, report it to the committee or the representative, who may consult with the OHS Section of the Public Service Commission; and
- May, where the matter is not remedied to the worker’s satisfaction after the worker reports it in accordance with clauses (a) and (b), report it to the Director of Occupational Health and Safety Division of the Workers’ Compensation Board.
